Importing for resale: what changes
Short answer
Commercial intent does not change the duty rate, but it changes almost everything around it — entry type, fee structure, record-keeping obligations, and your legal exposure as importer of record.
The rate attached to a classification is the same whether you are buying one unit for yourself or a thousand to resell. What changes is the surrounding machinery, and that is where new sellers get caught out.
Entry type is the first difference. Shipments at or above $2,500 generally require a formal entry, which moves the Merchandise Processing Fee from a fixed low amount to 0.3464% of value with a $33.58 floor and a $651.50 ceiling. That ceiling is worth knowing: past roughly $188,000 of goods value the fee stops growing, which is one reason consolidating shipments can reduce total fees.
The second difference is legal. As importer of record you carry the obligation to classify correctly and to exercise reasonable care, and that obligation is not discharged by having a broker file for you. Records must be retained. Errors are correctable but penalties for negligence are real.
The third is planning. Since de minimis was suspended, business models that depended on shipping individual low-value parcels directly from an overseas supplier to a U.S. customer lost their economics — every order now attracts duty and an entry. Consolidating into bulk shipments and clearing them once generally beats per-order clearance, both on fees and on predictability.
For a genuinely commercial operation, a licensed customs broker is not an optional expense. The question is not whether to use one but whether your volume justifies also getting a binding ruling on your main products, which removes classification uncertainty entirely.
